IC Mobile LLC End User Software License Agreement (EULA)
1ACCEPTANCE OF TERMS
PLEASE READ THIS END USER SOFTWARE LICENSE AGREEMENT ("Agreement") CAREFULLY BEFORE INSTALLING, ACCESSING, OR USING THE IC MOBILE LLC ("IC Mobile") MOBILE APPLICATION ("Application"). BY CLICKING "ACCEPT," INSTALLING, OR USING THE APPLICATION, YOU ("User" or "You") AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT AND IC MOBILE'S PRIVACY POLICY, WHICH IS INCORPORATED HEREIN BY REFERENCE.
If you do not agree with these terms, do not install, access, or use the Application.
IC Mobile reserves the right to modify or update this Agreement at any time in its sole discretion. Updates will become effective upon posting within the Application or on icmobileapp.com. Continued use of the Application after such modifications constitutes acceptance of the revised Agreement.
2LICENSE GRANT & OWNERSHIP
IC Mobile grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Application on a compatible mobile device you own or control, strictly in accordance with this Agreement and applicable App Store or Google Play Store terms.
This license does not transfer ownership. All rights, titles, and interests in and to the Application — including all software, code, updates, enhancements, and intellectual property — remain the exclusive property of IC Mobile.
- • Reverse engineer, decompile, disassemble, or attempt to derive source code from the Application.
- • Modify, adapt, translate, or create derivative works of the Application.
- • Circumvent or disable security features.
- • Rent, lease, sell, sublicense, or otherwise transfer the Application to third parties.
- • Use the Application in violation of applicable laws or for unlawful purposes.
IC Mobile may collect and analyze anonymized technical and usage data to improve the Application and related services.
3PURPOSE & RESTRICTED USE
The Application is designed as a command, tracking, and decision-support tool for fire service operations and incident management ("Purpose"). It is not a substitute for professional judgment, training, or adherence to fireground protocols.
- • The Application is a tool to assist decision-making and is not intended to replace human oversight.
- • IC Mobile, its officers, employees, and affiliates are not liable for misuse of the Application or for decisions made based on its data.
You may not use, export, or re-export the Application in violation of U.S. export laws or regulations, including transfer to sanctioned countries or individuals.
4ACCOUNTS, SUBSCRIPTIONS & PAYMENTS
Access to certain features may require registration and an active subscription. By creating an account, you agree to provide accurate and complete information.
All subscriptions, purchases, and billing are processed exclusively through Stripe. By subscribing, you authorize IC Mobile to charge your designated payment method on a recurring basis until canceled in accordance with the applicable subscription terms.
IC Mobile reserves the right to suspend or terminate accounts for nonpayment, breach of this Agreement, or fraudulent activity.
5USER CONTENT & PROHIBITED MATERIAL
The Application allows users to upload department logos and other organizational images ("User Content"). By uploading User Content, you represent and warrant that you have all necessary rights, licenses, and permissions to use and share such content.
You agree that you will NOT upload, post, or transmit any content that:
- • Contains nudity, pornography, or sexually explicit material
- • Depicts or promotes violence, hate speech, or discrimination
- • Contains offensive, defamatory, or harassing content
- • Infringes on intellectual property rights of others
- • Violates any applicable local, state, federal, or international law
- • Contains malware, viruses, or malicious code
- • Impersonates another organization or misrepresents affiliation
- • Is unrelated to legitimate fire service or emergency response purposes
- • IC Mobile reserves the right to review, monitor, and moderate all User Content at any time.
- • New department logos may be subject to a review process before being made visible to other users.
- • IC Mobile may, in its sole discretion, remove, reject, or block any User Content that violates this Agreement or is deemed inappropriate.
- • IC Mobile is not obligated to pre-screen content but reserves the right to do so.
If you encounter content that you believe violates this Agreement or is otherwise objectionable, please report it immediately by contacting:
All reports will be reviewed promptly, and appropriate action will be taken.
Violation of this User Content policy may result in:
- • Immediate removal of the offending content
- • Temporary suspension of your account
- • Permanent termination of your account and access to the Application
- • Legal action, if applicable
- • Reporting to appropriate law enforcement authorities
IC Mobile reserves the right to take any of these actions without prior notice.
By uploading User Content, you grant IC Mobile a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and store such content solely for the purpose of providing and improving the Application.
You acknowledge that IC Mobile is not liable for any User Content uploaded by third parties and that you use the Application at your own risk.
6TERMINATION
- • Violate this Agreement.
- • Use the Application for purposes inconsistent with its intended use.
- • Request account deletion.
- • Are required to do so by law or court order.
Upon termination, your license will immediately cease, and you must uninstall the Application. IC Mobile is not liable for termination-related consequences.
7DISCLAIMER OF WARRANTIES
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- • THE APPLICATION WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
- • THE APPLICATION WILL MEET YOUR REQUIREMENTS.
- • ANY DATA OR INFORMATION PROVIDED WILL BE ACCURATE OR RELIABLE.
Your use of the Application is solely at your own risk.
8LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IC MOBILE, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OR INABILITY TO USE THE APPLICATION.
IC MOBILE'S TOTAL LIABILITY FOR ANY CLAIMS UNDER THIS AGREEMENT SHALL NOT EXCEED FIFTY DOLLARS ($50.00).
Some jurisdictions do not allow limitations on certain liabilities, so some of the above limitations may not apply to you.
9INDEMNIFICATION
You agree to indemnify, defend, and hold harmless IC Mobile, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to:
- • Your misuse of the Application.
- • Violation of this Agreement.
- • Violation of any applicable law or rights of a third party.
10GOVERNING LAW & DISPUTE RESOLUTION
This Agreement is governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions.
All legal actions or proceedings arising under this Agreement shall be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to the jurisdiction and venue of such courts.
11MISCELLANEOUS
- • This Agreement constitutes the entire agreement between you and IC Mobile regarding your use of the Application.
- • If any provision is found unenforceable, the remaining terms shall remain in full force and effect.
- • No waiver shall be effective unless in writing and signed by both parties.
- • IC Mobile may transfer or assign this Agreement in connection with a merger, acquisition, or sale of assets.
- • You may not assign this Agreement without IC Mobile's prior written consent.
12THIRD-PARTY PLATFORMS
Use of the Application on Apple® or Android™ devices is subject to the respective platform terms. In the event of a malfunction on an Apple device, your sole remedy is a refund of the purchase price, if any. Apple Inc. and Google LLC are third-party beneficiaries of this Agreement and may enforce its terms against you.
